JUSTICE SUDHIR SINGH ORAL ORDER 07-05-2015 The petitioners are apprehending their arrest in connection with Agiaon (Garahni) P.S.Case No. 126/2014 instituted under Sections 406, 420, 409/34 of the Indian Penal Code.

As these cases arise out of the same police station case number, they have been heard together and are being disposed of by this common order.

Heard learned counsel for the petitioners and the State. The prosecution story, in brief, is that the informant, namely, Manoj Kumar, Block Development Officer, Garhani Bhojpur submitted a written report to the officer-in-charge of Garhani Agiaon police station alleging therein that in the Gram Panchayat Baraura under BRGF Scheme relating to 13th and 14th Finance Commission, financial irregularities is said to have been committed to the tune of Rs. 12,14,713/- and requested to register the case against these petitioners.

It is submitted on behalf of the petitioners that they have falsely been implicated in this case. It is further submitted that there has been no financial irregularly. On behalf of the State, it has been submitted that the

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Arrah, in connection with Agiaon(Garahni) P.S.Case No. 126/2014 , subject to the conditions as laid down u/s 438(2) Cr.P.C. Each of the petitioners are directed to deposit an amount of Rs. 25,000/- (twenty five thousand) in the court below, which shall be subject to the final result of the case.
