JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-05-2015 Heard learned counsel for the petitioner, learned counsel for the Informant as well as learned Additional public prosecutor appearing on behalf of the State.

The petitioner seeks anticipatory bail in a case registered for the offences punishable under Section 406 of the Indian Penal Code.

The gist of allegation against the petitioner, is that he had entered into an agreement to transfer a piece of land which belonged to one Sushma Kumari, through power of attorney for a sum of Rs. 8,40,000/-. The petitioner is said to have received total sum of Rs. 4 lacs from the complainant in this connection and is

Learned counsel for the petitioner submits that this is a case of civil nature. However, on the basis of instruction which he has received from his client and referring to the statement made in paragraph 7 of this application, he submits that the petitioner is ready to refund the entire amount of Rs. 4 lacs to the informant within a period of six weeks from today.

In view of the nature of allegation and fair stand taken by the learned counsel for the petitioner, let petitioner above named in the event of his arrest/surrender within two weeks after 7.7.2015 and he will have to produce before the Court below something in token of proof that he refunded the amount to the complainant, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Sri Mithilesh Kumar, J.M. Ist Cass, Muzaffarpur in complaint case No. 692/2013 ( Tr. No. 4642 of 2014), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
