The petitioner apprehends his arrest in a case under Sections 414, 467, 468/34 of the Indian Penal Code. A truck (bearing registration no. JH-1AE-4313) loaded with coal was seized. It is alleged that the papers show that the truck was carrying 19.980 Kg. of coal but on physical weighing, the truck was found carrying 39,795 Kg. of coal and the papers shown with regard to the payment of tax and carrying of coal appeared to be forged. It is submitted that the petitioner is the owner of the truck. A transporter, namely, Raghuvar Road Lines had hired the truck of the petitioner and the driver was driving the truck. A report was called for from the investigating officer as well as the Superintendent of Police with regard to the genuineness of the documents submitted by the truck driver but it

Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Aurangabad (M) P.S.
