JUSTICE AJAY KUMAR TRIPATHI ORAL ORDER 12-02-2015 The writ application is dismissed for the simple reason that the petitioner's case has been duly considered by the District Programme Officer after placing it before the Committee, which has clearly held that Circular No. 04 dated 4-1-2010 lays down that no benefit of graduate trained scale is going to be extended from the back date. So long such a Circular remains in existence, Annexure-1 cannot be said to be illegal. The petitioner may challenge the said Circular, if he so wants.

The writ application stands dismissed.
