JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 26.07.2017 passed in Cr. Misc. No. 33847 of 2017 with an observation to conclude the trial within a period of nine months.

Submission of learned counsel for the petitioner is that only the case has been committed and there is no progress in trial and petitioner is in custody for the last one year. Further submission is that the victim girl in her statement under Section 164 Cr.P.C. has not disclosed about any allegation of misbehaviour against the petitioner.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, named above, be

No.31440 of 2018 (2) dt.21-06-2018 2/2 released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura, in connection with Murliganj P.S. Case No. 120 of 2017, on the condition that one of the bailors shall be a local person having sufficient immovable property within the jurisdiction of the court concerned and petitioner has to co-operate in disposal of the trial, otherwise his bail bond shall be cancelled.
