The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 504/34, 506 of the Indian Penal Code and 3(1) (x) of the S.C./S.T.(Prevention of Atrocities) Act. It is alleged that the accused petitioners took two fish from the son of the informant and a protest was being made by the son of the informant then the petitioners assaulted the informant and her son and abused by calling caste name.
It is submitted by the learned counsel for the petitioners that for the occurrence of 04.12.2014 the First Information Report was registered on 15.01.2015,
Patna High Court Cr.Misc. No.13076 of 2015 (2) dt.30-03-2015 whereas the petitioners have lodged a case against the informant on 04.12.2014. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Gopalganj in connection with Gopalganj S.C./S.T. P.S. Case No. 07 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
