JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-03-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

It is alleged that the informant paid rupees ten lacs out of rupees twelve lacs of consideration amount for transfer of land to the petitioners but subsequently the petitioners neither transferred the land in favour of the informant nor returned the money.

It is submitted by the learned counsel for the petitioners that there is no proof with regard to payment and admittedly the entire payment claimed to have been made in cash.

No.10993 of 2015 (2) dt.17-03-2015 2/2 It is submitted by learned counsel for the informant that the petitioners admitted the receiving of money but due to increase of price of land in question the petitioners agreed to return the money received instead of transferring the land. Considering the nature of accusation, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Balia P.S. Case No. 186 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
