JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 16-01-2015 The petitioner was made an accused in Itarhi Police station Case No. 34 of 2008 dated 2.5.2008 under sections 364/120B of the Indian Penal Code. However, police after investigation submitted final form in favour of the petitioner recording that a false case was deliberately filed to unnecessarily trouble the accused (petitioner ). The police as such recommended a proceeding under sections 182 and 211 of the Indian Penal Code.

Grievance of the petitioner is that the same has not yet been initiated.

It will be open for the petitioner to approach the

Patna High Court CWJC No.18567 of 2008 (3) dt.16-01-2015 2/2 concerned Magistrate drawing his attention to the said recommendation of the police.

With the liberty aforesaid, the writ petition is disposed of.
