The petitioner apprehends his arrest in Maharajganj P.S. Case No. 07/2016, registered for the offences punishable under Section 7 of the Essential Commodities Act.

The informant alleged that eight quintals of wheat was found at the vehicle. The villagers disclosed that the petitioner is the owner of the wheat and he purchased the same from the Public Distribution System shop dealer Akhileshwar Prasad. It is submitted that the petitioner is not the owner of the vehicle. Nothing has been recovered from the conscious possession of the petitioner.

Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a

Patna High Court Cr.Misc. No.17155 of 2016 (2) dt.16-05-2016 2/2 period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Maharajganj P.S. Case No. 07/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
