The petitioners are in custody since 08.05.2023 in connection with Bhairavsthan P.S. Case No. 51 of 2023 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act and Section 272/273 of the Indian Penal Code.

There is recovery of 486 litres illicit Nepali liquor. The petitioner No. 1 and the petitioner No. 2 have two antecedents of similar nature.

Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case on the basis of suspicion. It is further submitted that recovery has been made

However, learned A.P.P. appearing on behalf of the State vehemently opposed the bail application. In view of the aforementioned facts and circumstances, let the petitioners above named be released on bail after completion of six months in custody, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, Jhanjharpur, Madhubani in connection with Bhairavsthan P.S. Case No. 51 of 2023.

The petitioners are directed to appear before the Bhairavsthan Police Station on the 1st Sunday of each month. (Sandeep Kumar, J) Saif/- U T
