JUSTICE ARUN KUMAR ORAL ORDER 04-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 23.5.2018, seeks bail in Chakiya PS Case No. 90 of 2004 registered under Sections 341, 323, 504 and 34 of the IPC.

It is a case of misuse of privilege of bail.

This is a case of the year 2004, the petitioner was declared absconder, he was granted bail by the police itself however after taking cognizance there was no service of any process, however the petitioner has surrendered before the Court and charge too has been framed.

Having considered the said facts and circumstances, the petitioner, namely, Afroz Ansari is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri S.M.Tripathi, Judicial Magistrate, lst Class at Motihari Sadar in connection with Chakiya PS Case No. 90 of 2004 with the condition that the petitioner shall appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
