2. The petitioner is in custody in connection with Sangrampur P.S. Case No. 184 of 2023 for the offence punishable under sections 366(A), 323, 504, 34 of the Indian Penal Code and later added Section 366(A), 376 of IPC and 4/6 of POCSO Act lodged on 14.05.2023 by the informant, Sitaram Yadav.

3. As per the prosecution story, the informant alleged that his minor daughter was out to attend the nature's call when the accused persons including the petitioner took her away for the purpose of marriage. This led to the lodging of the FIR,

The girl was also recovered and she made a statement under Section 164 of the Cr.P.C. in which she claimed herself to be 22 years old, she further narrated to have married this petitioner as her family members wanted her to marry somewhere else. They traveled to Tamil Nadu and upon knowledge about the case, returned. She further wanted to live with this petitioner.

4. Upon notice, the informant has appeared and according to the learned counsel representing her, the girl is now in the house of the petitioner, out of consummation of marriage with him, a child has also arrived in this world.

5. Taking into account the aforesaid facts as also his period of custody (28.04.2024), he has no criminal antecedent, in that background, this Court is inclined to extend him the privilege of bail with conditions.

6. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned 6th Addl. Sessions Judge cum Special Judge, POCSO Act, East Champaran, Motihari in connection with Sangrampur P.S. Case No. 184 of 2023 subject to the following conditions: (i) one of the bailor should be the family

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Vijay Singh/- U T
