2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 120(B) and 506 of the Indian Penal Code.
3. Complainant alleges that the accused persons were giving his land on Batai and accordingly he went to the Anchal Office to inquire and came to know that, based on forged partition deed, they have got his land mutated. Further from partition deed, it appears that the stamp paper is of 2015 and the partition is of 2002.
4. Learned counsel appearing for the petitioner submits that the dispute is of civil nature. Petitioner is own
Patna High Court CR. MISC. No.51804 of 2023(2) dt.19-08-2023 2/2 brother of the complainant. Several co-accused, with similar allegation, have already been allowed pre-arrest bail different co-ordinate bench of this Court vide orders passed in Cr.Mis.No. 65007/2019 and 29931/2023. Petitioner claims clean antecedent.
5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Danapur, Patna in Complaint Case No. 205 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
