JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Amba P.S. Case No. 46 of 2018 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that in the instant case 10 litres Mahua liquor was recovered. The petitioner is in custody since 05.06.2018. Learned counsel submits that the seizure list was not prepared as per the mandatory provision prescribed under Section 100 of Cr.P.C.

Considering the quantity of liquor and also the fact that the petitioner has remained in custody for more than one month, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of
