JUSTICE SHIVAJI PANDEY ORAL ORDER 03-04-2017 The present case has been filed for violating the order dated 15.09.2009 passed in C.W.J.C. No. 12258 of 2009, which is as follows:- "The petitioner challenges the order passed in a disciplinary proceeding by the Central Bank of India whereby he has been dismissed. The said order has been affirmed in appeal.
Learned counsel for the Central Bank of India accepts notice and prays for and is granted time to file a comprehensive counter affidavit so that the matter may be disposed of at the stage of admission itself.
Put up this case "for admission" on 14th December, 2009."
The aforesaid order itself does not give any mandamus to the Bank concerned to act in a particular manner. Only the
Patna High Court MJC No.23 of 2016 (2) dt.03-04-2017 2/2 Court directed for listing the case for admission. Non-filing of counter affidavit does not constitute an act of contempt and this Court does not find that it is a fit case for contempt. This Court does not find any merit in the present application and the same is, accordingly, dismissed. (Shivaji Pandey, J) Mahesh/- U
