Petitioner seeks bail in a case registered for the offence punishable under Section 47(A) of the Bihar Excise Act. 60 litres of country made liquor is said to have been recovered from the shop of the petitioner and the petitioner managed to escape.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has no concern with the seized liquor. He has been falsely implicated in the case by the personnel of the Excise department as he failed to oblige the personnel of the Excise department by according him eatable articles free of cost. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VII -Cum- Special Judge, Excise, Aurangabad in connection with Excise Case No. 38 of 2009.
