The matter at issue is non-payment of contractual dues of the writ petitioner.

In the counter affidavit filed on behalf of the respondent no.2, way back on 6th July, 2009, the claim of the petitioner has been disputed. Admittedly, till date, no rejoinder affidavit has been filed on behalf of the writ petitioner controverting the averments made in the aforesaid counter affidavit.

In above view of the matter, learned counsel appearing on behalf of the petitioner seeks permission to withdraw the present writ petition with a liberty to invoke the provisions of Bihar Public Works Contracts Disputes Arbitration Tribunal Act, 2008 for grant of appropriate relief.

Patna High Court CWJC No.3846 of 2008 (4) dt.26-02-2015 2/2 Permission is accorded.

The writ petition stands disposed of as withdrawn with the liberty aforesaid.
