The present petition has been filed with a prayer to restore M.A. No. 580 of 2012, which stood dismissed due to noncompliance of peremptory order dated 07-11-2014. By the said order, two weeks peremptory time was granted for filing limitation petition.
Learned counsel for the petitioner submits that limitation petition was filed, but due to inadvertence, it was filed after the expiry of peremptory time i.e. on 24-11-2014 instead of 21-11-2014.
In view of facts and circumstances, the restoration
Patna High Court MJC No.4901 of 2014 (3) dt.07-12-2016 2/2 petition is allowed.
Let M.A. No. 580 of 2012 be restored to its original file.
