The petitioner apprehends his arrest in Brahmpura P.S. Case No. 48 of 2015, registered for the offences punishable under Sections 379 and 511 of the Indian Penal Code. The principal of MIT, Muzaffarpur alleged that Santosh Kumar cut trees and wanted to take away. The petitioner was the driver of the tractor.
It is submitted that the petitioner was present at the place of occurrence but he did not cut trees. The tractor of the petitioner was hired and the petitioner thought that Santosh Kumar must have cut the trees after purchasing the same from the authority.
Considering the facts aforesaid, the petitioner above
Patna High Court Cr.Misc. No.13699 of 2015 (2) dt.08-05-2015 2/2 named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Brahmpura P.S. Case No. 48 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
