JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-11-2019 The petitioner, who is an Executive Engineer, seeks bail in anticipation of his arrest in connection with Rajaun P.S. Case No. 307 of 2016, dated 09.09.2016, instituted for the offences under Sections 409 and 420 of the Indian Penal Code.

The F.I.R. against the petitioner has been lodged by the Block Development Officer, alleging that the work under the Sampurna Gramin Rojgar Yojna was not executed fully and had been left unfinished. This information was derived from a complaint by one Surendra Prasad Singh, a villager.

Considering the facts aforestated, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Rajaun P.S. Case No. 307 of 2016, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Praveen-II/- U T
