JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-02-2021 In compliance of the order of this Court dated 28.05.2019 passed in CWJC No. 15747 of 2016, the respondents / contemnors have issued an order dated 11.11.2019 whereby and whereunder the joining of the petitioner has been accepted and as informed by the learned counsel for the petitioner, a sum of approximately Rs. 27,00,000/- has been paid to him on the head of salary.

Nonetheless, the learned counsel for the

Patna High Court MJC No.2781 of 2019(4) dt.03-02-2021 2/3 petitioner disputes the mode of computation of the amount of salary paid to him and seeks liberty to approach the respondent authorities for payment of the balance outstanding amount of salary.

Accordingly, the present petition stands disposed of as not pressed, however, with liberty to the petitioner to approach the Principal Secretary, Education Department, Government of Bihar, Patna, by filing appropriate representation regarding his subsisting grievances within a period of four weeks from today, which shall be disposed of by a reasoned and speaking order within a period of eight weeks, thereafter and in case, any outstanding dues are found payable, the same shall also be paid within a period of six weeks therefrom.

At this juncture, the learned counsel for the State, Ms. Shilpa Singh (GA-12), submits that an appeal bearing LPA No. 1228 of 2019 is pending adjudication, hence, the aforesaid order dated 11.11.2019 has been passed, subject to the final outcome of LPA No. 1228 of 2019.
