2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 332, 337, 353, 427, 504, 506 of the Indian Penal Code.
3. Learned counsel for the petitioner prays to withdraw the application on behalf of petitioner No.3, as he has already been arrested.
4. Accordingly, permission is granted.
5. The prosecution case reveals that Police had recovered

No.56566 of 2024(5) dt.10-04-2025 2/3 a dead body from river Punpun, which was kept near the bank of the river and it is said that a number of accused persons being 5 named and 10 to 15 unknown persons, including the petitioners, blocked the main road and when the Police tried to intervene in the matter, the crowd became agitated and they started pushing the policeman and hurled abuses and made slogans and thereby causing obstruction in the government duty.
6. The petitioner No.1 is innocent and has been falsely implicated in the present case. It is further submitted that there is general and omnibus allegation on all the accused persons and there is nothing specific on the petitioners. It has also been submitted that no injury has been caused to the informant or any member of the police party. Out of the several Sections which have been leveled against the petitioners, all other Sections are bailable except Section 353 of the IPC.

Learned APP for the State opposes the present bail application, besides others, even on the ground that petitioner No.2 is an accused in other case and also on the ground that they have objected to the discharge of government duty, in response to which, learned counsel for the petitioner submits that petitioner No.1 has no criminal antecedent and petitioner No.2
Patna High Court CR. MISC. No.56566 of 2024(5) dt.10-04-2025 3/3 has one criminal antecedent, in which he has already been granted bail.

Considering the fact that there is a general and omnibus allegation upon several persons and also considering the fact that no injury has been caused to any of the police personnel, let the above named petitioners, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Gaya, in connection with Gaurichak P.S. Case No.636 of 2023 subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482
(2) of the B.N.S.S., 2023 and subject to the further condition that the petitioner shall co-operate in the investigation/trial. (Soni Shrivastava, J) Sharun/- U T
