The petitioner apprehends his arrest in Sitamarhi P.S. Case No. 79 of 2014, registered for the offences punishable under Sections 147, 148, 341, 323, 324, 307, 504 and 506 of the Indian Penal Code.
The informant named the petitioner along with others and made allegation that Govind Kumar Singh @ Govind Kumar with dagger and other accused persons assaulted him with hockey stick on his head.
Learned counsel for the petitioner submits that Govind Kumar Singh @ Govind Kumar has already been granted anticipatory bail vide orders passed in Cr. Misc. No. 7563 of 2016 on 17.03.2016 by a coordinate Bench of this Court. The case of
Patna High Court Cr.Misc. No.16279 of 2016 (3) dt.10-05-2016 2/2 the petitioner stands on better footing as there is no specific allegation of assault against him.
Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Sitamarhi P.S. Case No. 79 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
