Petitioner seeks regular bail in connection with L.N.M.U. P.S. Case No. 55 of 2022 registered under Section 379 of the I.P.C.

As per the first information report the motorcycle of the informant was stolen from the premises of Shyama Mandir by the unknown persons.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case on the basis of confessional statement of one Alok Kumar, who was arrested by the Police in connection with the present offence. He next submits that stolen motorcycle has not been recovered from the possession of the petitioner and after his arrest the petitioner

Patna High Court CR. MISC. No.51554 of 2022(2) dt.09-12-2022 2/2 was remanded in other two cases also. Petitioner is in custody since 15.03.2022. There is no likelihood that petitioner will abscond or tamper with the evidence.

Regard being had to the submissions made by the parties, taking into consideration the fact that looted motorcycle has not been recovered from possession of the petitioner, he is in custody since 15/03/2022, charge sheet has already been submitted and there is no likelihood that petitioner will abscond or tamper with the evidence if released on bail, as such, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25000 /- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VIII, Darbhanga in connection with L.N.M.U. P.S. Case No. 55 of 2022 on the condition that the petitioner shall remain physically present on each and every date during the course of trial and in case of default on two consecutive dates, his bail bond shall liable to be cancelled.
