Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307 of the I.P.C and Section 27 of the Arms Act. It is alleged that during PACS election the informant and others were standing near the booth for casting his vote. In the meantime, to disturb the election process bombs were exploded and firings were resorted to, as a result the informant sustained injuries on left cheek and left leg when
Patna High Court Cr.Misc. No.7739 of 2015 (2) dt.03-03-2015 2/2 one Manikant Mishra sustained injuries on left leg and Ainu Naddaf sustained injuries on right leg.
It is submitted by learned counsel for the petitioners that injury of the informant was found to be simple when there is counter version of the occurrence also and petitioners' side also received fire arm injuries. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender within a period of six weeks and pray for regular bail in connection with Ghanshyampur P.S. Case No. 189 of 2014, pending in the Court of learned Chief Judicial Magistrate, Darbhanga.
Accordingly the application is disposed off.
