JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 28-04-2016 Heard the counsel for the petitioner and APP for the State. The petitioner seeks anticipatory bail in G.P. Nagar P.S. Case No. 34 of 2015 registered under section 307 IOPC. A supplementary affidavit is filed which is taken on record. It appears from Annexure-1 and Annexure-3 to the supplementary affidavit that both the parties indulged in Marpit. The petitioner is said to have assaulted the informant with iron rod which, however, caused injury simple in nature. It is stated that the petitioner also received injury on his head at the behest of the present prosecution side. In the counter case lodged by the nephew several persons sustained injuries. The accused persons of that case have been granted bail by the learned CJM. The petitioner does not carry any criminal antecedents.

No.17059 of 2016 (2) dt.28-04-2016 2/2 Considering the fact that both the parties received injuries inasmuch as the petitioner also received injury in which another case was lodged on the same day, as also the nature of injury sustained by the informant, I am persuaded to extend the privilege of anticipatory bail to the petitioner. Let the petitioner named above, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Siwan in G.B. Nagar P.S. Case No. 34 of 2015 on condition that one of the bailors shall be his own/close family member. He shall appear on each date fixed at the trial.
