The petitioners apprehend their arrest in Chenari P.S. Case No. 08/2016, registered for the offences punishable under Sections 341, 323, 379, 504 of the Indian Penal Code and Section 3(I)(X) of S.C./S.T. Act.

The informant alleged that his son went to the shop of Birendra Kumar Sharma (petitioner no. 3) to purchase some articles worth Rs. 75 and gave a note of Rs. 500/-, but only Rs. 25 was returned on such some altercation took place and the accused persons abused son of the informant and others by naming their caste and also assaulted them. Further petitioner no. 3 snatched

Patna High Court Cr.Misc. No.16277 of 2016 (2) dt.06-05-2016 2/2 silver chain from the neck of Byas Ram.

It is submitted that wife of petitioner no. 3 Radhika Devi earlier lodged Chenari P.S. Case no. 07/2016 alleging that the informant and his family members came to her shop and forcibly tried to take articles and also tried to outrage her modesty. There is a case and counter case between the two sides. Considering the facts aforesaid and the fact that there is a case and counter case and the entire occurrence took place in the shop of the petitioners, the above-named petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate - VII, Rohtas in connection with Chenari P.S. Case No. 08/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
