The petitioner is in custody since 03.03.2018 in connection with Daniyawan P.S. Case No. 23 of 2018, registered for the offence punishable under Sections 30 (a), 37 (b) of the Bihar Prohibition and Excise Act, 2016, Section 25 (1b) a, 26, 35, 27 of the Arms Act and Sections 147, 148, 149, 324 and 307 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Learned counsel for the petitioner further submits that co-accused was granted bail by order contained in Annexure-2.

Considering the fact that the petitioner has no criminal antecedent and co-accused were granted bail vide Annexure-2,

Patna High Court Cr.Misc. No.40774 of 2018(2) dt.10-07-2018 2/2 by co-ordinate Bench of this Court in Cr. Misc. No. 27851 of 2018 vide order dated 21.5.2018, let the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Additional Sessions Judge II-cum-Special Judge (Excise Act), Patna in connection with Special Case No. 1940 of 2018 arising out of Danyawan P.S. Case No. 23 of 2018.
