The petitioners, five in number, apprehend their arrest in Didarganj P.S. Case No. 178/15 registered under Sections 341, 323, 504, 354, 379/34 of the Indian Penal Code. The informant alleged that while she was returning to her house from Anganwadi Centre, Dharmendra Kumar, Akhilesh Kumar, Jitendra Kumar, Bittu Kumar and Chotu Kumar stalked her and began to hurl abusive language. It is further alleged that they all assaulted her. It is submitted that petitioner no. 5 Raj Ballav Singh is the own brother of the father-in-law of the informant. The husband of the informant is nephew of the petitioner no. 5 and cousin of petitioners no. 1 to 4. There is a

Patna High Court Cr.Misc. No.16290 of 2016 (3) dt.05-07-2016 2/2 counter-version being Didarganj P.S. Case No. 179/15. The witnesses stated that both the parties hurled abusive language on each other.

Considering the facts that the petitioners are close agnates of the husband of the informant and there is a case and counter-case, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Sanjay Kumar, Judicial Magistrate 1st Class, Patna City, Patna in Didarganj P.S. Case No. 178/15, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
