JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307 and 379/34 of the Indian Penal Code.
The accusation against the petitioner is of assaulting the informant with farsa.
It is submitted by learned counsel for the petitioner that in the background of land dispute, the accusation has been levelled and other co-accused have been granted anticipatory bail by the learned court below itself. Moreover, there is no injury report on record and the informant has subsequently retracted from his initial version and filed a petition to that effect before the learned court below.
The aforesaid facts constitute good ground for
Patna High Court Cr.Misc. No.7474 of 2015 (2) dt.26-02-2015 2/2 consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Jokihat (Mahalgaon) P.S. Case No. 50 of 2007 pending in the court of learned CJM, Araria. Accordingly, the application is disposed of.
