JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 06-04-2016 The present application has been filed for modification of order dated 13.02.2015 passed in Cr. Misc. No. 28849 of 2014 for extending the period of provisional anticipatory bail granted to the petitioner in connection with Complaint Case No. 874C of 2013 pending in the court of learned Judicial Magistrate, Ist Class, Udakishanganj, Madhepura. It is submitted by learned counsel for the petitioner that the DNA sample has not been taken as a result the DNA matching report could not come. Now the DNA sample has been taken and has been sent to the laboratory. It is further submitted that the bail bonds of the petitioner has not been cancelled.

Patna High Court Cr.Misc. No.12384 of 2016 (2) dt.06-04-2016 2/2 The prayer of the petitioner has not been opposed by the counsel appearing for the opposite party no. 2. In the circumstances, the order dated 13.02.2015 is modified to the extent that the period of provisional bail is extended for a further period of six months. The rest conditions as stipulated in the order dated 13.02.2015 shall remain the same.

Accordingly, this modification application is disposed of.
