28-04-2015 It was informed by learned counsel for petitioners that during the pendency of the writ petition, respondent no. 7 died, leaving behind her legal heirs, who are already party, as respondent no. 5 & 6, in the writ petition and he makes a prayer for expunging the name of respondent no. 7.

Learned counsel for petitioners is permitted to expunged the name of respondent no. 7 in course of the day. Heard learned counsel for petitioners, learned A.C. to Govt. Pleader - 25 as well as learned counsel for private respondents.

The present writ petition pertains to a dispute under the provision of Bihar Consolidation of Holdings and Prevention of Fragmentation Act, 1956, which is a scheduled Act under Section 9 of the Bihar Land Tribunal Act, 2009. The Court is of

Patna High Court CWJC No.15982 of 2008 (4) dt.28-04-2015 2/2 the opinion that this dispute can well be adjudicated by the Tribunal.

Accordingly, in view of proviso to Section 15 of the Bihar Land Tribunal Act, 2009, the Registry is directed to transmit the record of this case to the Tribunal forthwith. (Rakesh Kumar, J.) Anay/- U
