JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-05-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Sajour ( Sahkund) P.S.Case No. 183 of 2014 registered for the offences punishable under Sections 307 and other minor sections of the Indian Penal Code.

There is a case and counter case between the parties and father of the informant sustained grievous injury whereas informant of the case is said to have sustained simple injury. So far as , allegation is concerned, the petitioner no. 1 is said to have given one Hasua blow causing injury on the right hand of the

No.12317 of 2015 (2) dt.01-05-2015 2/2 informant and so far as petitioner no. 2 is concerned, it is alleged that she handed iron rod to co-accused Chamak Lal Singh and similarly, petitioner no. 3 is said to be an order giver. Considering the aforesaid facts and circumstances as well as submissions of the parties, particularly taking note of allegation leveled against the petitioners, this anticipatory bail petition is allowed and it is ordered that the petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate, Bhagalpur in Sajour ( Sahkund) P.S.Case No. 183 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
