The petitioners apprehend their arrest in connection with Barahiya P.S. Case No. 93 of 2025 registered for the offences punishable under Sections 126(2), 115, 109(1), 132, 352 & 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 37 & 45 of the Bihar Prohibition and Excise Act. 3.

The informant alleged that on 26-04-2025, while on duty, he received information that the accused persons were creating a ruckus under the influence of alcohol. When informant reached at the spot and tried to intervene, the accused

Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence as alleged against them and have falsely been implicated in the present case. There is delay of one days in lodging the FIR. There is general and omnibus allegation against the petitioners. From perusal of the impugned order, injury report of the informant is found to be simple in nature. Other co-accused has been enlarged on bail by this Court vide order dated 19-062025, passed in Cr. Misc. No. 38157 of 2025. 5.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.

Considering the rival submissions made by the learned counsel for the parties, let the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Barahiya
