The petitioner apprehends his arrest in Hilsa P.S. Case No.157/2018 registered under Sections 384 and 120(B) of the Indian Penal Code.

The gist of the allegation is that the petitioner being Vikashmitra and Amit Kumar, Assistant of Indira Awas used to take money from the beneficiaries of Indira Awas at the time of withdrawal of money by the beneficiaries.

Learned counsel for the petitioner submits that in the F.I.R. itself it would appear that Amit Kumar is alleged to have taken money from Smt. Gayatri Devi. None of the beneficiaries disclosed the name of the petitioner. Amit Kumar has already been

Patna High Court Cr.Misc. No.39513 of 2018 (2) dt.09-07-2018 2/2 granted anticipatory bail vide order dated 24.05.2018 passed in Cr. Misc. No.32010 of 2018. The case of the petitioner stands on better footing.

Taking into consideration the aforesaid fact and the fact that similarly situated co-accused has already been granted anticipatory bail, the petitioner above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Hilsa, Nalanda, in connection with Hilsa P.S. Case No.157/2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
