The petitioner apprehends his arrest in Sugauli P.S. Case No. 42 of 2014, registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code. In sum and substance the allegation is that the petitioner took Rs. 1,55,000/- from the complainant/informant for preparing passport and visa. The visa and tickets were also handed over to the complainant but the same were found to be fake. Learned counsel for the petitioner submits that the allegation is false. There is no chit of papers to show that the petitioner received any money.

Considering the facts aforesaid and the nature of allegation made against the petitioner, he, in the event of his arrest

No.7383 of 2015 (2) dt.23-02-2015 2/2 or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Sugauli P.S. Case No. 42 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
