JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-02-2024 The present writ petition has been filed seeking the following reliefs:- "1(a). For issuance of writ of Mandamus, Commanding the respondents concerned to accept the application form of the petitioner submitted for the post of Member, District Consumer Disputes Redressal Commission (District Commission), Khagaria corresponding to the advertisement No.01/21 issued by Director, Directorate of Consumer Protection, Food and Consumer Protection Department, Bihar, Patna, which was submitted within time and with all the requisite details as per the demand of the

Patna High Court CWJC No.18230 of 2021(2) dt.28-02-2024 2/3 advertisement, however the application form was arbitrarily and without any basis, summarily rejected by the department and conveyed to the petitioner through message (SMS) on his mobile phone on 26.8 2021.

(b). For issuance of Mandamus commanding the respondents concerned to immediately call and let him participate in the ongoing process for the selection against the post applied for.

(c). For directing the concerned authorities not to appoint any other person against the post for the district Khagaria, till the participation of the petitioner in the ongoing selection process and final selection of suitable candidate to be made only thereafter."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Principal Secretary, Food and Consumer Protection Department, Government of Bihar, Patna, for redressal of his aforesaid grievances. Liberty, so sought, is granted.

It is needless to state that in case, the petitioner files appropriate petition within a period of two weeks from today, the Principal Secretary, Food and Consumer Protection Department, Government of Bihar, Patna, shall consider the same, expeditiously.
