JUSTICE ARUN KUMAR ORAL ORDER 05-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 4.4.2018, seeks bail in Palasi PS Case No. 88 of 2018 registered under Sections 379 and 411 of the IPC.
Learned Counsel for the petitioner submits that the FIR is against unknown and the recovery of stolen motorcycle is shown from the house of the petitioner but it is a case of false implication, there has been no compliance of the provisions of Section 100 Cr.P.C. as copy of the seizure list was not given to the petitioner or any other family members and the petitioner bears clean antecedent. Having considered the said facts and circumstances, the petitioner, namely, Md. Salim is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM VI Araria in connection with Palasi PS Case No. 88 of 2018.
