JUSTICE RAVI RANJAN ORAL JUDGMENT Date: 03-03-2015 I have heard learned counsel for the petitioner and the State.

Grievance of the petitioner is that in terms of the direction of the State authorities contained in Annexures 1 and 2, she had supplied fuel during the Panchayat election which was to be held from 20.04.2011. Petitioner submits that even the admitted dues have not been paid till date and she is being compelled to run from pillar to post. It is further contended that part of the dues as advance were

Patna High Court CWJC No.3051 of 2015 dt.03-03-2015 2 / 2 given to the petitioner but the remaining amount of Rs.85,550.45/- are still to be paid.

If the petitioner's claim is correct then it is very unfortunate that the authorities of the State though had given direction to the petitioner to supply fuel but subsequently, they have given a deaf ear to the claims of the petitioner for payment of the admitted dues.

In the aforementioned facts and circumstances, this writ application is being disposed of directing respondent no.2, the Principal Secretary, Panchayati Raj Department, Government of Bihar, Patna to ensure payment of the admitted dues of the petitioner, if any, within a period of eight weeks from the date of receipt/production of a copy of this order. If the Principal Secretary comes to the conclusion after consideration of the case of the petitioner that the admitted dues have not been paid since 2011 without any fault on part of the petitioner, then he should ensure payment within further period of two months, failing which the unpaid amount would carry interest at the rate of 10% to be calculated from the date it became due to the date of its final payment.
