JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 This application, for grant of anticipatory bail, arises out of Risiup P.S. Case No. 20 of 2019, disclosing offences under Section 366 of the Indian Penal Code.

As per F.I.R., petitioner is the own uncle of the victim girl and there is allegation that he called the victim girl, thereafter, she was taken to Jamhore railway station and got boarded in the train of Delhi with one Ravi Kumar. After return from Delhi, her statement under Section 164 Cr.P.C. was recorded, in which, she has named this petitioner. Submission of learned counsel for the petitioner is that whole story is unbelievable as the petitioner is the own uncle of the victim girl and real fact is that she had gone with one Ravi Kumar out of her own will and further, the co-accused Shankar Yadav against whom there is allegation of threatening

Patna High Court CR. MISC. No.47499 of 2019(3) dt.25-10-2019 2/2 her has already been granted the privilege of anticipatory bail vide order dated 15.10.2019 passed in Cr. Misc. No. 47303 of 2019.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Risiup P.S. Case No. 20 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
