2. Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 14.03.2023 in Cr. Misc. No. 5097 of 2023.

3. Learned counsel for the petitioner has submitted that though earlier prayer for bail of the petitioner was rejected but the petitioner is renewing his prayer on the fresh ground that as per evidences of witnesses, six accused persons assaulted the deceased but as per postmortem report only two injuries are found to be present on the person of the deceased. He has also submitted that the charges have not been framed in the case.

4. In my view, there is nothing to consider the earlier

Patna High Court CR. MISC. No.52337 of 2023(5) dt.01-12-2023 2/2 order by which the prayer for bail of the petitioner was rejected.

5. Accordingly, the prayer for bail stands rejected.

6. The learned trial court is directed to expedite the trial and disposed of the same within a period of nine months. However, if the trial is not concluded within the stipulated period, the petitioner may renew his prayer for bail. (Nawneet Kumar Pandey, J) Nirmal/AKV U T
