The petitioner apprehends his arrest in a case registered under Sections 420 and 409 of the Indian Penal Code. In sum and substance, the allegation against the petitioner is that the petitioner, being the Headmaster of the School, did not provide mid-day meal on two dates. It is also alleged that some shortage of rice was also found. Learned counsel for the petitioner submits that the Project Officer of Mid-Day Meal held an enquiry and no irregularity was found. No shortage of rice was found. It has come during the course of enquiry that due to bereavement in the family of the cook, mid-day meal could not be prepared on 20th and 22nd September, 2014.

Considering the facts aforesaid and the nature of

No.8410 of 2015 (2) dt.02-03-2015 2/2 allegations made against the petitioner and the fact that in the enquiry the petitioner was not found to be guilty for not providing mid-day meal, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Jehanabad in Ghoshi P.S. Case No. 266/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
