Case No. 131 of 2019, disclosing offences under Section 366 of the Indian Penal Code.
Allegation against the petitioner is of kidnapping the minor daughter of the informant.
Submission of learned counsel for the petitioner is that the girl has been recovered and her statement under Section 164 Cr.P.C. was recorded, in which, she stated that she went with the petitioner to Goa and, thereafter, she came back and started residing in the house of petitioner's maternal grand mother and she has not alleged that she was forcibly taken by the petitioner and she has disclosed her age as 17 years. Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Town P.S.
