The petitioner apprehends his arrest in Complaint case No. 208C2/ 2016 registered under Section 47(a) (f) of the Bihar Prohibition & Excise Act.
The Excise officials raided the place of the petitioner where the petitioner was preparing country made liquor of Mahua situated in village Banjhi Piyar but the petitioner after seeing the Excise officials fled away. From the place of occurrence 10 liter country made liquor made of Mahua and 100 Kg. Jawa Mahuwa were recovered.
The learned counsel for the petitioner submits that nobody has disclosed the name of the petitioner. The complainant did not disclose anywhere that from where he came
Patna High Court CR. MISC. No.49941 of 2019(2) dt.13-08-2019 2/2 to know about the name of petitioner. The petitioner is not the owner of the place from where recovery was made. The complaint case was filed after two days of the recovery but it appears that the Excise officials on secret inputs raided the place meant for manufacturing country made liquor of the petitioner but the petitioner managed to flee away. From the place 10 liter country made liquor and 100 Kg Jawa Mahuwa were recovered. Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same was rejected.
