Show-cause is available on the record, which was earlier filed at the end of the contemners. However, the matter was passed over at the request of learned counsel for the petitioner. After going through show-cause coupled with the Annexures, it is evident from Annexure-D Series that after calculating and adjusting the amount, Rs.38,530.50/-, still remains due over the petitioner. However, the aforesaid fact has been controverted by the learned counsel for the petitioner who, fairly concedes that now, the dispute arose over claim and counter-claim for which, petitioner will file detailed representation before the competent authority, but so far continuity of instant M.J.C. is concerned, the same be dropped with a liberty to the petitioner to raise the issue before the appropriate authority in terms of Annexure-D Series.

Patna High Court MJC No.877 of 2011 (08) dt.20-05-2016 With the aforesaid liberty, instant petition is hereby dropped.
