JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2018 Heard the learned counsel for the petitioner and State. The petitioner is in custody in connection with Special Case No. 640 of 2018 for the offence under Sections 30(a), 38 of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody in connection with seizure of 235 liters of cough syrup which is allegedly used as substitute for liquor. Learned counsel submits that three persons were apprehended at the spot and they have disclosed the name of the petitioner as such the petitioner is implicated in this case. The learned counsel submits that the petitioner is in custody since 03.06.2018.

Considering the fact that the petitioner has no criminal antecedent, the petitioner, named above, is directed to be
