JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-03-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Bihariganj P.S. Case No. 127 of 2014 registered for the offence under Sections-307, 380 & other minor sections of the Indian Penal Code.
There is allegation of assault against all the petitioners and it appears that altogether three persons sustained injuries, though said to be simple in nature. Considering the facts and circumstances of the case as well as submission of the parties, prayer for anticipatory bail of
Patna High Court Cr.Misc. No.9411 of 2015 (2) dt.10-03-2015 2/2 the petitioners in connection with Bihariganj P.S. Case No. 127 of 2014 pending in the court of Sub Divisional Judicial Magistrate, Udakishunganj, District-Madhepura/concerned court stands rejected.
However, if, the petitioners surrender in the court below and seek regular bail within four weeks from today, the concerned court shall pass appropriate order on the regular bail petition of the petitioners on the same day without being prejudiced by this rejection order.
