2. The petitioners seek regular bail in connection with Dumraon P.S. Case No.294 of 2023 lodged under Sections 147, 148, 149, 324, 307 and 302 of the I.P.C.
3. As per the prosecution case, the F.I.R. has been lodged against six named and two unknown accused persons including the present petitioners against whom there is allegation that they in connivance with each other attacked on the brother of the informant on his neck and back side due to which he become injured and during treatment, he died.
4. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.55030 of 2024(2) dt.31-08-2024 2/2 petitioners are innocent and have committed no offence. He submits that they have falsely implicated in this case due to dirty village politics and personal enmity. He further submits that the other accused persons have been granted bail.
5. Counsel for the petitioners submits that petitioners are in custody since 19.07.2023 having clean antecedent.
6. Learned counsel for the State opposes the prayer for bail and submits that there is direct allegation against the petitioners that they have attacked by Garasa on the neck and the back side due to which brother of the informant died.
7. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioners. Therefore, the bail application of the petitioners are hereby rejected.
