The petitioner apprehends his arrest in Sahebpur Kamal P.S. Case No. 222 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.
The informant Arvind Yadav alleged that he is a driver of jeep and while he was going Kare Singh and Sadhu Singh intercepted him and began to assault on the allegation that the jeep pushed them. The informant fled away from there and thereafter it is alleged that both the accused persons caught him. Kare Singh pointed a pistol and Sadhu Singh assaulted him with bricks and sticks and with butt of a pistol.
Learned counsel for the petitioner submits that prior to filing of the present case, Sadhu Singh filed Sahebpur Kamal
Patna High Court Cr.Misc. No.1579 of 2015 (2) dt.14-01-2015 P.S. Case No. 221 of 2014 registered under Section 307 and some other Sections of the Indian Penal Code, in which Sadhu Singh has made very specific allegation that the petitioner pushed the bullock cart of the informant when the informant Sadhu Singh objected, the informant of this case, Arvind Yadav assaulted him with iron rod.
From the records, it appears that the allegation of assault is made against Ajay Singh @ Sadhu Singh and five injuries were found out of which one injury was found on the nose which is opined to grievous and four injuries are simple. Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Deopriya Kumar, the learned Judicial Magistrate, 1st Class, Begusarai in connection with Sahebpur Kamal P.S. Case No. 222 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
