2. The petitioners are seeking regular bail in connection with Sonbarsa P.S. Case No. 61 of 2024 for the
Patna High Court CR. MISC. No.57926 of 2024(2) dt.23-08-2024 2/3 offences punishable under Section 21(c) of the NDPS Act.
3. As per allegation, the medical shop of the petitioners was raided by the members of Border Security Force. On search, 1416 bottles syrup, 1170 tablets of Nitravate, 280 of tablets of Nitrasun, Noofin injection 600, Diazelab 300 injection and mobile were recovered from the shop of the petitioners.
4. The learned Senior counsel for the petitioner has submitted that the FIR itself shows that the petitioner Manoj Mahto is proprietor of a medical store and the petitioner Sunny Kumar is the son of Manoj Kumar. The seized article are the medicines.
5. The father of the petitioner Sunny Kumar has been granted a license under Drugs and Cosmetics Act. The petitioners are the persons of clean antecedent and they are under custody since 17.02.2024.
6. On the other hand, the learned counsel for the informant has opposed the prayer for bail.
7. Considering the above-mentioned facts and circumstances, let the petitioners above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) each with two sureties of the like amount each to the
Patna High Court CR. MISC. No.57926 of 2024(2) dt.23-08-2024 3/3 satisfaction of learned Special Judge, Sitamarhi in connection with Sonbarsa P.S. Case No. 61 of 2024, subject to the following conditions:- (i) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.
